Our law firm's team successfully resolved arrears of alimony resulting from the obligor's failure to comply with the maintenance indexation mechanism ordered by a court in the UK.
In this case, the alimony obligation was established in a final court decision, which provided for annual adjustments to the alimony amount based on inflation (the Consumer Price Index – CPI). Despite the express provision in the decision, the obligor continued to pay the maintenance amount for several years without the required adjustment.
Following our payment demand – which included a detailed calculation of the underpayment and documentation confirming the obligation to adjust the amount – the obligor settled the arrears without the need for court or enforcement proceedings.
This case demonstrates the importance of not only collecting the basic alimony payments but also enforcing all provisions of the decision – including those concerning adjustments to the alimony payment due to rising living costs.
The law firm represented the person entitled to alimony, providing comprehensive legal support during the analysis of the decision and the effective recovery of the debt.
