Although the protection of personal rights is most often discussed in the context of individuals, it's worth remembering that legal entities – including companies – are also subject to protection, and damage to their goodwill or reputation can lead to serious legal consequences.
LAWSTORY was contacted by an entrepreneur whose company had been affected by such a violation. Our client had provided certain services to the other party. Despite these services being completed and a settlement reached, the other party not only made unjustified claims for additional services but also – when the client proposed an addendum stipulating payment for these services – threatened to publicly "damage his reputation."
The threats quickly turned into action – posts containing false and defamatory information about our client's company began appearing online. Despite demands to remove them and cease the infringement, the author of the posts not only failed to comply but also demanded PLN 100,000 for each removal.
This case, beyond the obvious violation of a legal entity's personal rights, also involves blackmail and threats of property damage, making it particularly significant from a legal perspective. Settlement talks were unsuccessful, and the matter was referred to court.
This is a reminder that a company's personal rights, such as its good reputation, are protected just as much as those of an individual – and actions aimed at deliberately damaging them, especially financially motivated, can result in both civil and criminal liability.
